A RESOLUTION TO EXPRESS THE INTENT OF VILLAGE COUNCIL REGARDING A CERTAIN APPROPRIATION PROPOSAL
Introduced by Mr. Gordon.
WHEREAS, some residents of the Village of Riverlea have requested that Village Council take actions to construct a pedestrian pathway from Riverglen Drive in the Village to Evening Street in the City of Worthington, over real property that was originally platted as a part of Pioneer Street in the Village, but for which property the public use for street purposes has been vacated by the Village, and such property now is in private ownership; and
WHEREAS, although Village Council desires to consider all alternatives available to establish safe pedestrian ways for use by Village residents and visitors, Village Council also desires to provide assurances to Village residents and to the property owners that would be affected by construction of a pathway in such location that the Village does not intend to acquire an interest in private property for pathway purposes without the agreement of the affected property owners to such an acquisition.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF RIVERLEA, STATE OF OHIO:
Section 1. NO INTENT TO USE EMINENT DOMAIN. That the Village Council of the Village of Riverlea hereby expresses the present intent of a majority of its current members not to utilize its right to appropriate by legal action any interests in property that is not publicly owned for the construction of a pedestrian pathway from Riverglen Drive in the Village north to Evening Street in the City of Worthington.
Section 2. EFFECTIVE DATE. That this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.
Section 3. OPEN MEETINGS. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.
Section 4. PUBLICATION. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Resolution in a newspaper is unnecessary and does hereby determine that this Resolution shall be published by posting copies hereof in the five following places, which are determined to be the five most public places in the Village of Riverlea, Ohio:
The Circle on West Riverglen Drive.
The Ravine Park on West Riverglen Drive.
The Northwest corner of Beverly Place and Dover Court.
Lot 75 on West Riverglen Drive.
Lot 7 on West Southington Avenue.
Copies of this Resolution shall be posted continuously in the above-mentioned places for a period of fifteen (15) days and at the expiration thereof this Resolution shall become effective.
